Gerbiamas Pone Nausėda,
Šiuo laišku mes, Europos Parlamento nariai, reiškiame gilų susirūpinimą tuo, kad vykdant žurnalisto, politiko ir valdžios kritiko Algirdo PALECKIO baudžiamąjį persekiojimą, 2021 metų liepos 27 d. Šiaulių apygardos teismas nuteisė jį 6 kalėjimo metams už “šnipinėjimą”.
Tiriamoji žurnalistika nėra šnipinėjimas, net jeigu jos objektas yra jautrus vyriausybei. Policijos, prokuratūros ir Valstybės saugumo departamento vadovai grubiai pažeidė A. Paleckio nekaltumo prezumpciją, kuomet per jų garsiąją bendrąją spaudos konferenciją 2018 m. gruodžio 19 d. jie apkaltino jį ”šnipinėjus“, nors tuo metu ikiteisminis tyrimas buvo ką tik pradėtas ir joks teismas dar nebuvo paskelbęs savo nuosprendžio. Kaltinimai A. Paleckiui yra paremti vieno ir vienintelio liudytojo liudijimu, kuris yra pažeidžiamas dėl kitos jam iškeltos baudžiamosios bylos.
Šiaulių apygardos teismas iš esmės nukopijavo baigiamąją prokurorės kalbą į savo nuosprendį, atsisakydamas nagrinėti bylą bent kiek giliau ir pasikliaudamas Valstybės saugumo departmento pažymomis, kurios atsispindi departamento nuomonę.
Ikiteisminis Algirdo Paleckio kalinimas vienutėje, trukęs 528 dienas (17 mėnesių), ženkliai pakenkė tarptautinei Lietuvos reputacijai, ir mes nuoširdžiai norėtume išvengti tolesnės žalos jai.
Kaip ES narė, Lietuva yra įpareigota gerbti teisę į žodžio laisvę, kuri yra įtvirtinta ES Pagrindinių Teisių Chartijoje. Ši teisė apima laisvę reikšti numones, taip pat gauti ir skleisti informaciją bei idėjas be valdžios įsikišimo ir nepaisant sienų.
Mums kelia nerimą pastaraisiais metais auganti saugumo tarnybų įtaka politiniams procesams Baltijos šalyse. Tai lėmė ne vieną žurnalistų, visuomenininkų ir politikų sulaikymą, kas yra nepriimtina Europos Sąjungoje.

Dear Mr Nausėda,
With this letter, we, Members of the European Parliament, are expressing our deep concern about the criminal prosecution of Algirdas PALECKIS, a politician, journalist and Government critic sentenced on 27th of July 2021 by Šiauliai district court to 6 years in prison for “espionage”.
Investigative journalism is not tantamount to espionage, even if its topic is sensitive for the Government. The presumption of innocence was blatantly breached by the heads of Police, of the Prosecution office and of the State security department as they jointly and publicly accused Algirdas Paleckis of ”spying“ before any investigation had been completed or any trial had reached any conclusion, during the infamous press conference on the 19th of December, 2018 in Vilnius. The accusation against Paleckis is based on the testimony of solely one witness who is vulnerable due to another criminal case raised against him.
The Šiauliai district court basically copy-pasted the final prosecutor’s speech into its decision, refusing to analyse the dossier any deeper, relying on the memos written by the State security department which contained the department’s point of view.
The pre-trial detention of Algirdas Paleckis which lasted for 528 days (17 months) in solitary confinement has inflicted severe damage to Lithuania‘s international reputation, and we sincerely wish to avoid any further deterioration.
Lithuania as an EU Member State is obliged to respect the right to freedom of expression as set out in the EU Charter of Fundamental Rights. This right shall include freedom to hold opinions and to receive and impart information and ideas without interference by public authority and regardless of frontiers.
We are concerned about the rising influence of the security services on the political process in the Baltic States in recent years. This has led to the arbitrary detentions of a number of journalists, civil activists and politicians, which is unacceptable in the European Union.
